These benefits can cover medical care, lost wages, and certain other expenses related to your injuries.

Michigan also enforces a “one-year-back rule.” This means you cannot recover expenses that were incurred more than one year before the date you actually file the claim. Starting care and documenting everything early is critical.

2. Personal Injury Lawsuits (Pain and Suffering) – 3 Years If your injuries meet Michigan’s “serious impairment of body function” threshold, you generally have three years from the date of the crash to file a third-party lawsuit against an at-fault driver for pain and suffering damages.

3. Property Damage / Vehicle Repair – 3 Years You typically have three years from the accident date to pursue a claim against the at-fault driver for vehicle damage that is not covered by your own policy or through the mini-tort process.

4. Accidents Involving Government or Municipal Vehicles – Much Shorter If your accident involved a city, county, or state vehicle (such as a police car, transit bus, or road maintenance vehicle) or a dangerous road condition, the notice requirements are much stricter. In many cases, you may only have 120 days to 6 months to provide proper notice. These shortened deadlines can catch people by surprise.
